Member Contract

As a member of Asheville LETS (ALETS), I agree to the following:

  1. The name of this network is Asheville Local Exchange Trading System, referred to as Asheville LETS or ALETS in “Asheville LETS Guidelines”, “Member Contract” & “Principles”.
  2. Asheville LETS is a favor exchange network operated by volunteers on a not-for-profit basis. Asheville LETS provides an information-based community self-help program by linking needs with volunteers in the community for mutual benefit. The purpose of the program is to strengthen the community and to increase access to services and resources for all in the community.
  3. Members may give or receive from each other credits in the accepted LETS unit of account (referred to as 'LETS' or 'LETS credits' herein), the value of which is determined by the membership. LETS credit is a measure intended to motivate volunteers to contribute to the community. LETS credits have no monetary value, are not associated with any monetary value, and cannot be exchanged for US dollars or any other national currency. Asheville LETS facilitates the informal exchange of similar services on a non-commercial basis. LETS are backed only by the moral obligation of members and are not legally binding.
  4. Members are under no obligation to trade, or to accept any invitation to trade. However, members agree to return the balance of their account to zero or higher before leaving the system permanently.
  5. Members are free to set prices at whatever rates they choose; however, should either party in an exchange wish to utilize multiple systems of exchange (eg. LETS and US dollars) to settle accounts, members agree to accept more than half LETS for services offered through the ALETS directory.
  6. Members with web-based accounts accept responsibility for checking their email every week so that they can monitor their accounts for error. If they do not check their email once a week, they forfeit their right to dispute transactions made in error during that period of time.
  7. This system is accessed by children and no sexually suggestive submissions may be published in the printed directory. Additionally, by signing the Membership Application, each ALETS member agrees not to submit any illegal listings. The ALETS Organizing Group may remove a directory submission or cancel an exchange at its discretion. Listings must be legal, respectful, honest and truthful. It is the responsibility of each member to abide by these standards.
  8. ALETS is designed to facilitate the exchange services, not commercial goods. Members may recirculate salvaged material resources through the ALETS directory, but agree to charge only for the time and energy they spend preparing and delivering those resources.
  9. Members' Offers and Wants are listed in an online and printed directory accessible to ALETS Membership. A Member Name and preferred contact method (phone and/or email) is included with each listing. ALETS members, in signing the Membership Application, agree to use contact and account information of other members only for the purposes of LETS-related communication. Members agree to directory information without contact information being made accessible to the general public.
  10. ALETS will make public accounts of any US dollars coming into the system or used in running the system.
  11. US dollars are not deposited into or issued from the ALETS accounts. Members may engage in any transaction entirely in LETS, or on a part cash basis, but only LETS are recorded in the ALETS accounts.
  12. All accounts start at zero. Members are not obliged to have earned LETS before issuing credit to another member, subject to exchange limits set by the membership. Currently ALETS members are required to maintain a balance between -300 or +300 LETS. These limits are meant to encourage continuous trade and prevent abuse of the system. They may be changed by the ALETS membership at a regular ALETS meeting. If this happens, the Organizing Group is required to inform each member of the change. If a member’s balance exceeds one of these limits, ALETS organizers may contact that member, requesting that s/he take action to stay within the guidelines. If a member does not take actions to correct the balance exceeding standing limits, the ALETS membership may choose to close that member's account at the request of the Organizing Group. The Organizing Group may then inform other ALETS members of the closure and take down that member's directory listings.
  13. All members are asked to contribute $10 annually (or similar amount determined by the membership at a regular ALETS meeting) to cover web hosting, stamps, printing and mailing directories, LETS voucher books, pamphlets, a PO Box, a voice mail account and other cash only expenses.
  14. The work of organizers will be on a volunteer basis for the first year the system is operating, after which point organizers will volunteer the first hour worked each week, and will be compensated in LETS for subsequent hours at a rate determined by the membership at a regular ALETS meeting.
  15. Only the account holder can authorize the transfer of LETS from their account to that of another except for essential administrative charges consensed upon by the membership at regular ALETS meetings, which may be transferred by administrators from members' accounts to the ALETS system account. The account holder (member) authorizes the transfer of LETS out of their account by filling out and signing a LETS voucher, or by “gifting” an amount to another member.
  16. Members are engaged in ALETS as individuals, families, or collectives. ALETS defines an “individual” as a single person, and “family” as a group of related individuals with long-term ties. ALETS defines “collective” as a group of individuals voluntarily organized for mutual benefit with each member holding equal authority. Family and collective accounts must have a single contact over 18 years of age who takes responsibility for the obligations of the account (such as ensuring quality of services and returning the balance of the member account to zero if the family or collective decides to leave the system). Parents/guardians are responsible for supervising the activities of minors using a family account. Each ALETS Account must have at least one individual who is over 18 years of age to serve as contact.
  17. Members agree to allow ALETS to hold their account information in a database and distribute relevant account information (such as balance and balance history) to other members. Members authorize ALETS organizers to maintain and update their account information.
  18. The administrative body (“Organizing Group”) is made up of active ALETS members. Members of the ALETS Organizing Group work for, and are accountable to, active ALETS members. Active members are those who have completed at least one exchange in the last 90 days.
  19. ALETS meetings operate through a formal consensus process as defined in the document “Asheville LETS Consensus” (available on the website and on paper by request). All decisions are made through consensus, not through voting, except in the rare instance that two members volunteer for the same position and one does not withdraw (as detailed in section 6.8 of the Guidelines). Members are encouraged to attend ALETS meetings and those who are not present delegate their decision making to those who attend the meeting.
  20. Members are individually responsible for their own personal tax liabilities and returns and for any benefits entitlements. ALETS as a group has no liability regarding members' taxes and benefit entitlements, and has no obligation or liability to advise its members, maintain records or collect payments for tax and benefit authorities. Members are responsible for contacting their tax accountant and / or attorney with any questions relating to tax liability.
  21. Members are responsible for the quality and value of services exchanged under ALETS. No warranty, guarantee or endorsement by ALETS is implied or extended by the listing of member’s information in the directory. ALETS disclaims any liability or responsibility for the exchanges agreed to by ALETS members.
  22. Members agree to be bound by the conditions of the Member Contract, Guidelines and Principles of Asheville LETS.
  23. Asheville LETS, a member-run network, reserves the right to make changes to the Membership Application, Member Contract, Guidelines, web system and other relevant forms in the future. Members will be notified of significant changes, and a lack of stated objection communicated to the Organizing Group will be deemed agreement to the changes. Asheville LETS Principles can never be changed.
  24. In the event of a dispute, members agree to attempt in good faith to mediate such dispute with a mediator acceptable to both parties, such as The Mediation Center.
  25. Membership in the LETS system implies acceptance of the conditions of this agreement.
